Die Österreichische Finanzmarktaufsichtsbehörde (FMA) kann gemäß § 92 Abs. 11 1. Satz Wertpapieraufsichtsgesetz 2018 (WAG 2018) durch Kundmachung im Internet oder in einer Zeitung mit Verbreitung im gesamten Bundesgebiet die Öffentlichkeit informieren, dass eine namentlich genannte natürliche oder juristische Person zur Vornahme bestimmter Wertpapierdienstleistungsgeschäfte (§ 3 Abs. 2 Z 1 bis 4) nicht berechtigt ist, sofern diese Person dazu Anlass gegeben hat und eine Information der Öffentlichkeit erforderlich und im Hinblick auf mögliche Nachteile des Betroffenen verhältnismäßig ist.

Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 08.03.2019 teilt die FMA daher mit, dass

nicht berechtigt ist, konzessionspflichtige Wertpapierdienstleistungen in Österreich zu erbringen. Es ist dem Anbieter daher die gewerbliche Anlageberatung in Bezug auf Finanzinstrumente (§ 3 Abs. 2 Z 1 WAG 2018) nicht gestattet.

L’Autorité autrichienne des marchés financiers (FMA) peut informer le public conformément à l’article 92, paragraphe 11, première phrase de la loi de 2018 sur la surveillance des valeurs mobilières (WAG 2018) en annonçant sur Internet ou dans un journal diffusé sur le territoire fédéral qu’une personne physique ou morale nommément nommée Les opérations sur titres de services (§ 3, al. 2, alinéas 1 à 4) ne sont pas autorisées, à condition que cette personne ait fourni des motifs et que l’information du public soit requise et que le désavantage éventuel de la personne concernée soit proportionné.

Avec sa publication au journal officiel „Amtsblatt zur Wiener Zeitung“ du 08.03.2019, la FMA informe que:

The Austrian Financial Market Authority (FMA) may inform the public in accordance with § 92 para. 11, 1st sentence of the Securities Supervision Act 2018 (WAG 2018) by announcing on the Internet or in a newspaper with distribution throughout the Federal territory that a natural person or legal entity named by name shall make certain Securities services transactions (§ 3 para 2 points 1 to 4) is not entitled, provided that person has given cause and information of the public is required and in terms of possible disadvantages of the person concerned is proportionate.

With its publication in the official gazette „Amtsblatt zur Wiener Zeitung“ dated 08.03.2019 the FMA informs that:
