Die FMA kann durch Kundmachung im Internet oder in einer Zeitung mit Verbreitung im gesamten Bundesgebiet die Öffentlichkeit informieren, dass eine namentlich genannte natürliche oder juristische Person zur Vornahme bestimmter Bankgeschäfte (§ 1 Abs 1 BWG) nicht berechtigt ist, sofern diese Person dazu Anlass gegeben hat und eine Information der Öffentlichkeit erforderlich und im Hinblick auf mögliche Nachteile des Betroffenen verhältnismäßig ist.

Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 10.09.2019 teilt die FMA daher mit, dass

nicht berechtigt ist, konzessionspflichtige Bankgeschäfte in Österreich zu erbringen. Es ist dem Anbieter daher der gewerbliche Handel (§ 1 Abs 1 Z 7 BWG) nicht gestattet.

The FMA may notify the public by way of publication on the Internet, or in a newspaper with nationwide circulation that a named natural or legal person is not authorised to perform certain banking transactions (Article 1 para. 1 BWG), provided that this person has given cause for such action and informing the general public that is proportionate with regard to any potential disadvantages for the affected parties.

By publication in the official gazette “Amtsblatt zur Wiener Zeitung” on 09.09.2019, the FMA hereby informs that

is not entitled to carry out banking transactions in Austria that require a licence. The provider is therefore not permitted to trade on a commercial basis (Article 1 para. 1 no. 7 BWG).
