Die Österreichische Finanzmarktaufsichtsbehörde (FMA) kann ua gemäß § 4 Abs 7 Bankwesengesetz (BWG) die Öffentlichkeit informieren, dass eine namentlich genannte natürliche oder juristische Person zur Vornahme bestimmter Bankgeschäfte (§ 1 Abs 1 BWG) nicht berechtigt ist, sofern diese Person dazu Anlass gegeben hat und eine Information der Öffentlichkeit erforderlich und im Hinblick auf mögliche Nachteile des Betroffenen verhältnismäßig ist.
Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 27.04.2019 teilt die FMA daher mit, dass

nicht berechtigt ist, konzessionspflichtige Bankgeschäfte in Österreich zu erbringen. Es ist dem Anbieter daher der gewerbliche Handel auf eigene oder fremde Rechnung (§ 1 Abs 1 Z 7 BWG) nicht gestattet.

The Austrian Financial Market Authority (FMA) may, inter alia, in accordance with § 4 para 7 Banking Act (BWG) inform the public that a named natural or legal person is not authorized to carry out certain banking transactions (§ 1 Abs 1 BWG), if this person has given cause which requires information from the public and is proportionate to the potential disadvantages of the person concerned.
With announcement in the official gazette to the Viennese newspaper of 27.04.2019 the FMA informs therefore that

is not entitled to perform banking transactions requiring a license in Austria. Therefore, the provider is not permitted to trade on its own or for another’s account (§ 1 para. 1 no. 7 BWG).
